COMMISSION POLICY

Thank you for your interest in my art! Please look over my policies, it makes the process a LOT easier, and if you have any questions just ask!

GENERAL

  • Channel donations are not considered as payment towards commissions. If you would like to get a commission, you must fill out the request form and I will send you an invoice where you can pay directly through my website with PayPal or Credit/Debit Card. This is the only way I will accept payment for orders since your order will be clearly defined to avoid any confusion!

  • Tips are never expected but always appreciated <3! If you would like to include a tip for your order you can do so directly through my PayPal - paypal.me/spectissa.

  • These are current prices and are subject to change.

  • ALL PRICES ARE IN USD.

COMMISSIONS

  • Work on commissions does not begin until terms of payment have been agreed upon.

  • Commissions are processed on a first come, first serve basis.

  • I require full payment up front

  • I try to get commissions done as soon as possible but please allow about 2-3 weeks just to be safe. Bigger and more complex orders may take longer. If there is a deadline I need to know about, please let me know in the order form so I can tell you if it can be completed by then.

  • At times I stream my commission work, I will give you a heads up if I will be working on your commission work live, however, if you are uncomfortable with this, let me know in your request. Please don't demand when your commission is streamed, I have a fairly strict process and workflow in order to get commission done in a timely manner.
     

LICENSING AND ROYALTY

  • If you want to use the art for stickers and other merchandise to be distributed or sold, an additional fee equal to the price of the commission will be charged.

  • I can not license designs based off of derivative work (fan art) 

  • I have the right to use the work and designs in my portfolio and all social media. If commercial use is purchased it will still be used in my portfolio. If you have any questions or concerns, feel free to ask about it!


REVISIONS

  • There are unlimited revisions during the concept and sketching phase (within reason), however, once a sketch has been approved and has moved on to line-art, it will be minor revisions only, if major changes are to be made after sketch is approved, there will a charge for a minimum of a new emote.


RUSH ORDERS

  • Rush order pricing is usually available. Please contact me about my availability first.

  • For an additional 50% of the price, you will be added to my priorities list and your work will be completed between 2-7 business days and charged based on the work commissioned. (eg. one emote = $45, A rush order of one emote = $67.50). I will give you a timeline quote when you place your order.

CANCELLATIONS

  • If you want to cancel your order and I've already started on it, 50% of the total commission price will be refunded. If sketches are approved no refund will be given. 

  • I have the right to refuse any commission. Commissions I cancel will be given a full refund.
     

CONTENT RESTRICTIONS

  • I do not draw NSFW, violence, hateful or racist subject matter. (Lewd is A-OKAY)

  • I will not create an exact copy of another artist's art.

  • I do not give out or sell editable files.

  • I will make fanart but I can not give you permission to sell merch with it's design in accordance with Federal Copyright Law

PRE-MADE DESIGNS

  • It is understood that purchasing pre-made designs does NOT grant you exclusive use of these designs. You are purchasing the digital files not the rights to the artwork.

  • Pre-made designs are NOT to be edited or distributed.

  • I want to make my art accessible to many, so making these non-exclusive keeps the prices low.

OTHER

If you wish to add to your order, please do so before the invoice is sent. Purchasing items at the same time gives you more of a discount! I can not offer bundle pricing for additional items at a later time.

If you still wish to add to your order, and it is after your sketches have been approved, the addition will be processed as a separate order and will be put in the next open slot. This is to keep my commissions running smoothly and be fair to my other clients.

Be honest during sketching phase the more feedback I have the better. I try my best to make you happy and I want to be sure you get what you want! Please credit me when you can, it makes me smile UwU.

TERMS OF SERVICE

​IMPORTANT INFORMATION
Read the following Terms and Conditions carefully. When you order or use the artist's products that implies that you have read and accepted the following Terms and Conditions.


AGREEMENT SUMMARY
You (Commissioner): You have the authority to enter into this contract on behalf of yourself, your company or your organisation. You’ll give the artist the assets and information they tell you they need to complete the project. You’ll do this when the artist asks and provide it in the formats they need. You’ll review the artist's work, provide feedback and approval in a timely manner too. You are responsible for approving and requesting changes.


The Artist: The artist has the experience and ability to do everything agreed upon with you and they will do it all in a professional and timely manner. They will endeavor to meet every deadline that is set and on top of that, they will maintain the confidentiality of everything you give them. The artist will provide the sketch(es), and at this stage you can correct the artist and give the feedback required to complete the project. Payment needs to be paid on the website provided by the artist based on the agreed upon invoice prior to the start of the project. After payment is received, the commission will begin.


The artist has all rights to cancel or refuse the commission and refund the whole payment. Furthermore, if the commissioner decides to cancel the commission after the sketching process has been completed, half of payment will be refunded. After the artwork is completed and shown to the commissioner, no refunds are accepted.


DISPLAYING WORK
The artist reserves the right to display all aspects of their creative work, including live--streaming, recorded videos, sketches, work-in-progress designs and the completed project on their portfolio as well as all forms of media.


CHANGES AND REVISIONS
All changes MUST be made before project is still in rough draft phase. Once final art is sent and work is done changes are not possible. Only changes that are possible even after artwork is finished are simple changes in color (Twitch Emoticons and Subscriber Badges ONLY). Due to realistic constraints, the artist has the right to take artistic freedom as long as it fits within the guidelines of the requested art.


REFERENCES
You must supply all references unless otherwise agreed on. If not the artist has the right to artistic freedom. Changes may be requested at the time of rough drafts.


LICENSE AGREEMENT
You are granted a nonexclusive limited license to use the art in accordance with these Terms and Conditions (the “license”) There are NO refunds and NO exchanges.


NON-EXCLUSIVE LICENSE AGREEMENT
The art is not for resale. Original purchasers may use the art for personal use ONLY.


MODIFICATIONS
You may NOT modify the art in any form otherwise stated.


COPYRIGHTS
You may use the art for your personal use only. Unless you had purchased a license, the art may not otherwise be reproduced or distributed in any way into another document or material without prior written permission from me. Any copy of the art must retain all copyright and other proprietary notices contained therein.


OTHER MERCHANDISE
Arts are NOT to be used on other merchandise unless written permission from the artist has been granted and a license has been purchased.

TERMINATION
You may terminate this agreement at any time by destroying all copies of the art.  Your license to use the art will terminate immediately if you breach this agreement.


LEGAL
The artist can’t guarantee that our work will be error-free and so the artist cannot be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you have advised us of them. Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and the ability to enforce any remaining provisions.
